And as for MX-980 Coolbuy sells it for 775$ and you still have to get a professional installer to program it, at this price it's insane! So if I get my money back I might stick to MX but it is so expensive in Canada I would buy a cheaper model. Mike you know my setup what should I get to match my MRF-350 and serve me well. Do you know another place than Coolbuy in Canada to get a URC remote and THE SOFTWARE?

I won't know when the carrier will be at my doorstep he will leave me a pick-up form but I will not see him. I usually get to the post office after I got my delivery notice and then I can refuse the package. I want to make this right so I try to figure out exactly how I should do it. I'm not familiar with this and you must have figure out that I'm a french canadian and english is far to be my first language.

IF you buy the remtoe from an authorized dealer (list found on URC's site), you can get the software. Make sure to confirm this ahead of time, big-box stores (Magnolia, Tweeter, etc) have been known not to give out the software easily. Many internet dealers will, just make sure you confirm this ahead of time.

are you going to program this remote yourself?

you could always send it to somebody on this board to program it for you, I would be willing to do a basic program for you to hold you over until the software is available. The 980 is a great remote, I hate to see you not be able to use it.

The thing is I won't have the software with it...
Anyways here's my setup:
- TV Sharp LC52D82U
- Receiver Yamaha HTR6060
- DVD-R Samsung R160
- CD player Sony CE215
- HDPVR Explorer 8300
- DVD player Toshiba SD-430V
- Sony PS3 80 Go with dyno Bluwave IR (I'll have to switch for the IR2BT when avalaible)
- HD-DVD player Toshiba HD-A30
- IR-543 for 14 X-10 modules & switches
If what you just told me is possible, you got the software and it is'nt too expensive I would absolutely do that. Let me know if you can. I'm kind of sad to let this remote go but if that's the only way to get my money back instead of a pretty remote that does'nt work... And if there's an avalaible software online it wont have the upgrades and I would like to have the Blu-Ray, HD-DVD, PS3 & X-10 Logos. I also wait for my MRF-350 to arrive. Nobody seems to be positive about the future availability of the software. (MX-980)

It will take about 2 billing cycles to work it out but

The item is "Significantly Not as Described" as it can't be programmed without the software. Unless the seller specifically disclosed in his ad that the remote did not come with the programming software, it is "Significantly Not as Described". Beyond Ebay, selling the remote without disclosing you're not getting the software is deceptive and likely subject to legal action against the seller if you wanted to take it that far.

Well Mike in the description the software was'nt mentioned so I can't really say that it is "Significantly Not as Described". I have a lot of time right now since I got one of my thumbs cut with a glass at work and I'm staying home for around 4 weeks still so if there's any legal actions I can't take I will. Another poster mentioned me he could program the remote for me just check the last post on the first page of this thread. Is that possible or should I just stick with sending back the remote and/or take legal actions to the seller.

I just sent him an e-mail that says:

What should I do go on with this dispute with the seller and get a refund, get the remote proggram by someone else, return my MFR-350 as well or stick to MX products and buy another remote from an authorized dealer just like you. (if you ship in Canada with the software)

I don't think it matters. They sold you an item for which they are not authorized to sell and of which is not useable. They can disclaim the warranty until they are blue in the face. The fact is they sold you an un-authorized product which is not fit for the purpose of which it's intended. Not only does this violate UCC but they may also be treading into transhipping violations as well.

If they were a stand-up company they'd accept an un-opened return of the product and only keep the shipping or at worst a 10% restocking fee. But from the looks of this seller $ellittoday, just the name sounds shady and BTW who has that many barbie dolls for sale along with remotes? You'll have to way your options yourself. I'd venture to guess the product is stolen or gray-market and may even have the serial # removed (they have unboxed the item already before shipping to you). And FYI, if/when URC releases the limited use mx-980 software on the net you will need this serial # to obtain it.

You know my stance on the issue....refuse the package and dispute the charge. Best of luck...one of the main reasons I deal locally as much as possible.

p.s. if you get this resolved and can't find someone local the guys that advertise on this forum like Surf and Proremotes are authorized and stand up guys. I've seen them help many people dozens and dozens of times so you could buy from them and support would be available in the future as well. This "pawn shop" you bought from will never support your product.

Thanks for that post tweeterguy I never even wonder about this black market or stolen product thing. Should I get legal action with the protection of consumer office. (I don't know if you call it like that it's just a word for word translation from french) + I have a lot of time in my hand right now I could do this. It seems I won't find a way to settle this down with the seller peacefully so I need to know what my options are since I'm kind of new with ebay...

it is symantics at this point. from a sellers point of view (that is you) stick to your guns, "They sold you something that does not and can not work."

it is not useable. it is defective. whatever you call it. in my mind it is a scam for them to sell you something that they darn well know the end consumer can not program.

maybe you could mail it to someone to program for you. maybe you could recoupe some cash by selling it on eBay (stating you have no software). or just refuse delievery and contact your credit card company to dispute the charges.

leave him negative feedback it that is what he does to you. make sure in the feedback you state NO SOFTWARE MEANS NO PROGRAMMING or somelthing like that so potential buyers know what is up.

He's really in a jam for a number of reasons. There are no Canadian retailers that sell URC products for a reasonable price. URC is not very interested in Canadian sales and authorizes one distributor who simply refuses to price reasonably.

Of the US sellers, only ProRemotes and BlueDo will sell to Canadians. Unfortunately both use UPS, a terrible service for importing to Canada. Damon's great to deal with and my BlueDo experiences in the past have been good, but lately reports aren't so good. But again, it's UPS and UPS alone. Mike won't sell to Canadians.

That leaves Canadian customers for URC products in a complete jam. Pay over MSRP from the "authorized" distributor. Pay exorbitant UPS brokerage fees. Or be at risk for less than honourable eBay retailers.

In this case, I would suggest that the you give a shot at phoning URC and explaining the situation. Acknowledge that they, in terms of their support policy, don't have an obligation to assist, but that any help would be appreciated. Also acknowledge that you are aware that you have no warranty and that you will not be seeking technical support from URC.

If they won't help, I hope you are successful in returning the remote. If you are, you may want to look at purchasing a URC remote from Damon at ProRemotes or David at BlueDo (make sure to e-mail for special pricing).

I still haven't figured out why Mike or Damon don't use a service like Borderfree to sell to Canadians. They'd move a lot of product since as consumers we're completely at the mercy of a price-gouging distributor.

I am sticking to my guns but when I read the item description it seems pretty obvious that I have nothing to back me up... And I don't think this story will get fixed between me and $ellittoday, if I want to win I'll have to go further. I don't exactly know how you call the ''consumers protection office'' but should I take it to the next step since $ellittoday's not willing to take the remote back?

Your right about how hard it is to deal with URC over the lines. Our dollar got way stronger but the price did'nt change at all up here. Its 775$ for a street legal MX980 in Canada, yeap is that bad! I'm probably in the worse country to get electronic goodies. I also wait on a RF station for a different seller and I won't use it either because URC's not for us Canadian... (I mean me and the other 6 or 7) The MRF-350 was'nt an auction. It's a store named VVincent Audio that look pretty clean compare to the other and he still sells some RF station. (''buy it now'' not an auction) (no ''no return policies'' and anything mentioned about warranty-exchange) I want to return my MRF-350. Can I? (I just want re-send it unpacked when it arrives)

Does that mean I really have to keep the remote. I'm really sorry to bother you with my mistakes but I need to know what are my options for sure before I get into any legal action. You know the guy who does'nt read carefully prior to buy? I'm that guy. I did'nt think about asking about the software prior to bidding because I assume that the remote comes with the software.
