You tried to work it out with the seller, but he is being unreasonable.
At this point, all you have to do is refuse the package and file a dispute with your credit card company. You'll get your money back, and there is nothing the seller can do about it.
No need to take any further actions as this will work and is very simple. Believe me, I've done it enough times to know.
If the software is made available in the future, you can always buy one then (from someone else, of course!).
