Why?
Because witnesses, cops, attorneys, judges make mistakes...and tell lies.
Many times witnesses cant even remember what the criminal looked like and they just guess at the line up. Or they wait for the cop to lead them to the "right" one. Cops will often make an assumption early on and stop the investigation and just try and manipulate reality to fit their guess. Video tape doesn't always tell the whole story.
I don't really care about the moral aspects of it. We as a species are always at war, we factory farm animals for food and i just murdered like a million insects in my back yard a couple days ago because i don't want my dogs to get tics so obviously humanity is cool with killing. But...Until we have technology that can allow us to look into peoples minds and know for sure i don't think the death penalty has a place in modern society.
I hear ya on the insects- I greased a bunch of ants yesterday that were loitering outside of my door.
Half of the time, witnesses can't remember what they had for breakfast, but what if there's video and other forensic evidence of a major crime, with the video showing that the person never left the scene and it can be proved that it wasn't edited? Pretty hard to say they didn't do it or it was a case of mistaken identity. If a cop loses sight of someone they're chasing, it can cause reasonable doubt but if there's nobody else in the area who comes close to the description, it's probably not going to.
