Does anyone have a good T&M disclosure statement/contract they'd be willing to share? I have a "Customer/Outside purchased disclsure/contract, but Im looking for something more so for CYA on a time and materials basis job. Im getting ready to bid a job that will be a "take over" from another local company, and there are just too many un-knowns to bid accurately.

Thanks

Hey Bunnyman, did you ask over at IP? I need the same thing. Let me know if you come across something. I tried my own and it always comes across as written by my attorney. I think this might be a turnoff to customers. I do a ton of fixerups.

I did, but no bites yet.

I just sent you what I DO have, which is a "outside purchased" disclosure. How does it compare to what you have?

Frank, I really like it! Now I wonder what my clients will think of it?
The one I was using was from my days with another company. It was so harsh that we stopped using it. I was only using it to CMA. Consider yours stolen. Plagerism should be considered flattery.

I stole it from somneone else, just not sure if it was here or ip. Anyway, its them who deserve the credit, not me. Its in Word format, (not pdf) so Im assuming they willingly gave it, knowing it would be modified. Though I dont remember who it was:) I just put it on ip for those who are interested.

How about this:

Customer agrees that all items listed in equipment list as OFE (Owner Furnished Equipment) are to be installed on a separately logged time and materials basis. Time logged will include research on control & integration, installation & configuration time on site, troubleshooting or any other work associated with these components. No warranty on hardware or installation will be provided for these components other than the installer warrants the work will be done in a neat and professional manner. Any service calls to correct any problems with this unit will be billable at the normal service call rate, at the sole discretion of the installer.

Chances are good that it will sound like an attorney wrote it unless you forget some pretty important picky little details. You know how tech talk can sound very much unlike normal people talking to each other? This kind of a document sort of has to be that way to spell everything out. The very fact that I used the word "document" shows this!
A good answer is easier with a clear question giving the make and model of everything.
