I'm sure Noel's lawyers are stuck in a snowdrift, trying to get to the courthouse as we speak!!!

It's funny how I've been seeing examples of things using the word Monster (oops...don't sue me Noel) and I pretend to be some slimebag lawyer ready to prepare a case.

Just drove by the new "Monster" Hair and Nail Salon in Woodinville, WA. Watch out gals... here comes Noel Lee and his scumsucking attorneys bent on your destruction because god only knows... your clients might get confused over whether they are buying cables or getting a haircut.

It could actually happen that Noel and gang sue that salon. And Julie, I love your sense of humor!

Actually, there IS a salon name that someone should have been sued for:

Tex's Chain Saw Manicure

And from "Runaway Bride," there was

Curl Up and Dye
A good answer is easier with a clear question giving the make and model of everything.

I recently read that Joel & Co were planning to sue the porn industry, but found they did'nt have enough lawyers to sue everyone, and also learned that while it seems to be illegal to utter the word "Monster" without a franchise agreement (mafia type payoff), there is no law against monster envy.
It's such a fine line between stupid, and clever.

There's no trademark for "Monster Snowstorm" - so no. but good attempt at the joke nonetheless. ;) But to be fair, Monster Cable Products, Inc. didn't sue Snowmonsters (other thread) anyway.

I don't think the actions of their legal staff (in email, on phone, etc.) was appropriate, but none of that consititutes a lawsuit. Some people are on the border of libel and slander though (with some of the unfounded comments).

I won't be buying Monster-branded products in the future both because I believe their bullying practises go far beyond the scope of mark protection and because their quality simply doesn't warrant their prices. I'd love to trade places with Noel though - those markups are delicious when you're on the collecting side.

What about the obvious target for Monster Cable... Monster.com? Seems like if they were actually concerned about the Monster trade name, they would go after somehting of actual value.

I'm guessing that avenue has already been explored by them, and I'm also guessing that Monster.com most likely has a relatively crack legal staff.

I think I heard they actually did go after them. I'm not sure what came of it, though.

I can't swear to it, but I believe Monster.com pays royalties to Monster cable. If not monster.com, then it's some other big Monster brand.

Comcast should also pay royalties for using the word "cable" in their marketing.
